Terms and Conditions

Just Jalan ("Event") is organised by Pro Bono SG (referred herein as the "Organiser"). These Terms and Conditions, which are uploaded on [https://justjalan.probono.sg], the Official Website of the Organiser, shall govern the Event.

By signing up for the Event, including but not limited to completing and submitting the online Event registration form, each individual (each a “Participant” and collectively “Participants”)) hereby confirm his/her agreement to accept and abide by these Terms and Conditions.
General
  1. The Participant agrees that registration in the Event is personal to the Participant and is not transferable to any other person, nor will any other person be permitted to participate in the Participant’s place.
  2. Each Participant certifies that he/she is 18 years of age or older at the time of registration for the Event. Applicants below 18 years of age need to obtain parental or guardian consent before participating in the Event and are to submit the consent form upon registration, failing which, the Organiser reserves the right to refuse registration or participation to any applicant under the age of 18.
  3. The Organiser reserves the sole right and discretion to set fees or donation or fundraising amount for the different categories comprising the Event.
  4. Registration for the Event is only confirmed upon successful payment of the registration fee and issuance of a confirmation email.
  5. Once the registration form submitted by or on behalf of the Participant has been duly processed and registration is successful, there will be no refund of registration fees, for any reason whatsoever including non-participation in the Event. It is the responsibility of the Participant to check that the registration form has been duly completed and submitted, and that such registration has been accepted by the Organiser. The Organiser shall not be responsible for incomplete entry details or the failure to process and accept the Participant’s registration, including but not limited to any technical glitches, faults and/or delays that may occur.
  6. The Organiser reserves the right to limit and refuse registration or participation without assigning any reasons thereof.
  7. The Organiser reserves the right to modify or substitute any of these Terms and Conditions from time to time as it deems fit without any notice or liability to any party. If there is ambiguity in any of these provisions, the Organiser’s interpretation shall be final and conclusive. Any amendments to these Terms and Conditions will be updated on the Official Website. All Participants understand and agree that by participating in the Event, they accept any change or update in these Terms and Conditions as updated by the Organiser from time to time.
  8. Participants acknowledge and accept that they will be required to use third party programmes, software, websites and applications and will be subject to the terms and conditions, including privacy policies, governing a Participant’s use of such third party programmes, websites and applications. PBSG and the organiser have no control over the rights and obligations governing a Participant’s use of any third party’s programmes, software, websites and applications.
  9. These Terms and Conditions shall be governed by and interpreted in accordance with Singapore law. The courts of Singapore shall have exclusive jurisdiction over any disputes arising from the terms and conditions, including the validity and enforceability thereto.
Personal Data and Media
  1. By registering for the Event, the Participant expressly agrees and consents to the collection, use and disclosure by the Organiser , as well as the Organiser’s representatives, agents and authorised service providers of the Participant’s personal data for purposes reasonably required by the Organiser to:
    1. Facilitate the registration by the Participant;
    2. Administer, conduct and manage the Event;
    3. Send updates and important information on the Event to the Participant;
    4. Post the Event results on the Official Website and/or on any other physical or electronic media whatsoever, now known or later developed;
    5. Promote the Event including using any photographs, videos, motion pictures, images, recordings or any othe recording of the Event and its Participants for any advertising or promotional purposes linked to the Event or future editions of the Event organised by the Organiser;
    6. Measure the success of the Event;
    7. Obtain feedback from participants on the Event;
    8. Plan and analyse risk for future editions of the Event;
    9. Send communications on future fundraising and outreach events organised by the Organiser, including updates on the Organiser’s charitable initiatives, donation drives and other related activites;
  2. You may withdraw your consent or opt out of receiving communications related to future fundraising or outreach collaterals by Pro Bono SG at any time by writing to DPO@probono.sg.
  3. The Participant’s consent herein supplement but do not supersede or replace any other consents that the Participant may have previously provided to the Organiser, and the Participant’s consent herein is cumulative and additional to any rights which the Organiser may have to collect, use and/or disclose of the Participant’s personal data to the extent permitted under applicable law.
  4. In addition, where personal data of any other person is disclosed by a Participant, that Participant further confirms and represents that they have obtained the consent of the individual concerned, unless such consent is not required under applicable laws for the Organiser’s collection, use and/or disclosure of such personal data.
  5. Each Participant hereby confirms and agrees as follows:
    • that the Participant hereby grants to the Organiser, a royalty free, worldwide, irrevocable, perpetual license to use, reproduce, adapt, make derivative works, distribute, publicly display, transmit, communicate, and publish any and all photographs, videos, images, recordings or any other form of record of the Participant’s participation in the Event or a related activity (the “Participant Media”), and to sub-license third parties to do so (collectively, “Use”);
    • that the Participant has full right, capacity, standing and authorisation to grant the foregoing license and permission to the Organiser;
    • that the Participant and/or all other natural persons who are featured or who are otherwise identifiable in the Participant Media consent, without any compensation, to Use of the Participant Media by the Organiser and any other parties permitted by the Organiser, for all and any lawful purposes, including publicity, marketing, administration, and reporting;
    • that the Participant releases and agrees not to sue the Organiser from all present and future claims regarding use of the Participant Media, by the Participant and their heirs, assigns, spouses, partners, personal representatives and/or next of kin;
    • that the Participant shall indemnify the Organiser and hold the Organiser harmless for any loss, damage or expense (including legal fees incurred by the Organiser on a solicitor-client basis) that may be suffered or incurred by the Organiser as a result of the Participant's breach of the foregoing;
    • that the Organiser is not obliged to Use the Participant Media.
  6. The Participant agrees to:
    1. provide true, accurate, current, and complete information about the Participant in the registration form (the "Registration Data"); and
    2. maintain and promptly update the Registration Data to keep it true, accurate, current, and complete.
  7. The Organiser may contact the Participant from time to time by email. Any notice sent to the email address registered with the Organiser shall be deemed as received by the Participant.
  8. If the Participant provides any information that is untrue, inaccurate, not current or incomplete, or if the Organiser has grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Organiser may reject, suspend or terminate the Participant's registration and participation, and block or otherwise refuse to permit any and all future use by the Participant of the Official Website or the Organiser's other media platforms and channels (or any parts thereof). The Organiser will not in any way be liable under, and shall not be obliged to entertain, any disputes, discrepancies or complaint arising from incomplete, untrue, not current, or inaccurate information provided by or on behalf of the Participant.
Modification, Postponement or Cancellation
  1. The Organiser reserves the right to amend the Event route or mechanism as they deem fit in their sole and absolute discretion without assigning any reason. In such cases, efforts will be made to inform the Participant prior to the date of the Event. The Organiser shall not be liable for any injury, damage, loss, expense, or inconvenience caused due to such changes.
  2. The Organiser reserves the right to cancel, postpone or modify any part of the Event or any component of it, including but not limited to the date and/or location, at any time without prior notice and without liability to the Participants. In the event of such cancellation, postponement or modification, the Organiser will post the details of cancellation, postponement or modification on the Official Website, and make an effort to inform the Participants prior to the date of the Event. If the Event or any component of it is cancelled, postponed or modified, there shall be no refund of registration fees paid and the Organiser shall not be liable for any other loss or inconvenience caused.
  3. Any feedback, complaints, grievances, objections, or protestations shall be made in writing to the Organiser. The Organiser is not obliged to consider or respond to any feedback, complaint, grievance, objection, or protestation. All decisions of the Organiser are final and conclusive.
Health and Safety
  1. The Participant declares and agrees to the following as a condition of participation in the Event:
    1. The Participant understands that participation in the Event may be physically demanding and declares that:
      1. The Participant is medically and physically fit and competent to participate in the Event; and
      2. The Participant is not aware of any condition, illness, injury, or disability of the Participant that would affect the Participant’s safety or physical wellbeing or that may cause or result in injury or death during or because of participating in the Event.
    2. In the event that the Participant’s state of health changes in the time between registering for the event and participation (e.g. due to illness or injury), resulting in non-participation of the Event, the Participant bears this risk alone and there will be no refund of registration fees.
    3. The Organiser reserves the right to refuse participation if the Participant is unwell and there will be no refund of registration fees.
    4. The Participant shall keep himself/herself informed of, shall be responsible for assessing and agree to solely assume all the risks of taking part in the Event notwithstanding any actions or activities undertaken by the Organiser and its employees, directors, agents or contractors in promoting, staging, organising or marketing the Event.
    5. The Participant must cooperate fully with the Organiser, stay on the planned route during the Event, wear the Event wrist tag, and diligently comply with all safety instructions, directions and requirements, including traffic regulations and any prevailing government guidelines. The Organiser reserves the right, without any liability whatsoever, to take such actions as it deems proper and reasonable for the safety of all or any Participants.
    6. Participants agree that in the event of any emergency, injury, illness or detriment whatsoever, they hereby irrevocably authorise the Organisers and officials to transport themselves to a medical facility and/or to administer emergency medical treatment and the Participant waive all claims that might result from such transport and/or treatment or delay or deficiency therein. The Participant shall repay or reimburse any expenses incurred by the Organiser for such medical and emergency treatment or action and the Participant hereby authorises the Organisers’ to incur the same. The Participant agrees that nothing herein shall oblige the Organiser to incur any expenses or to provide any transport or treatment.
  2. Additional responsibilities for minors. The Participant acknowledges and agrees that:
    1. Should the Participant choose to bring one or more children under the age of 12 years (hereinafter referred to as 'Minors') to the Event, the Participant assumes full responsibility for the health, safety, and well-being of such Minors while at the Event.
    2. The Participant confirms that they have the legal authority or parental consent to be responsible for any Minors they bring to the Event.
    3. The Participant agrees to supervise and monitor the Minors' activities at all times during the Event, ensuring that the Minors comply with all the safety instructions, directions, and requirements applicable to the Event.
    4. The Participant understands that the Organiser is not responsible for providing supervision or monitoring of Minors, and it is solely the Participant's responsibility to ensure the Minors' safety and compliance with the Event's rules and regulations.
    5. The Participant agrees to be solely responsible for any and all acts or omissions of the Minors, including any damage, injury, loss, or liability caused or incurred by the Minors.
    6. In the event of any emergency, injury, illness, or detriment involving a Minor, the Participant authorises the Organisers and officials to take the same actions as stipulated in the above terms for the Participant, including transportation to a medical facility and/or administration of emergency medical treatment, and the Participant agrees to bear any costs incurred for such treatment or actions for the Minors.
  3. Pets are welcome to participate in the physical walk. For the safety of all participants, Participants who bring their pets must:
    1. Ensure that their pet is physically fit to participate in the walk;
    2. Accompany their pet at all times during the walk;
    3. If the pet is a dog, keep it leashed at all times as required by law;
    4. Keep their pet under proper control to ensure that it does not cause a nuisance to any other person or pet;
    5. Take all reasonable steps to ensure that their pet does not injure, endanger, intimidate or otherwise cause distress to any other person or pet;
    6. Ensure that their pet does not damage or endanger any property.
Disclaimers
  1. Participation is at the Participant’s own risk. To the fullest extent permitted by law, the Organiser, its officers, staff, volunteers, agents, contactors, Event officials, Event sponsors and Event partners shall not be liable for any death, bodily injury, property damage or any other loss or damage, direct or indirect, that a Participant or their pet may suffer or incur in connection with the Event, the Participant's or their pet’s participation in the Event, any goods or services provided to or used by the Participant or their pet in connection with the Event, any computer result anomalies or any technical malfunctions.
  2. The Organiser assumes no liability or responsibility for any goods and/or services that are offered, provided, or made available by third parties in connection with the Event. Such goods and services are provided by such third parties as independent contractors in their own capacity and no relationship of agency exists between the Organiser and such third parties in relation to the Event. Any dispute(s) relating to such goods and services must be resolved directly with the applicable third party who supplied the same. Third party suppliers may impose conditions for the redemption of the goods or services.
Indemnity
  1. To the fullest extent permitted by law:
    1. Every Participant unconditionally and irrevocably waives all claims of whatsoever nature that the Participant and their heirs, successors and assigns may have against the Organiser and its officers, staff, volunteers, agents, contractors, event officials, event sponsors and event partners and insurers of such entities and any third party acting on its behalf or working within the framework of the Event (collectively, the “Indemnified Persons”).
    2. Every Participant agrees to hold harmless the Indemnified Persons for any damage to or loss of property, any injury or loss of life or any damages of any kind whatsoever, and keep the Indemnfied Persons fully and effectively indemnified from and against any and all losses, costs (including legal costs), claims, damage and expenses whatsoever which any of them may suffer or incur (directly or indirectly) as a result of or in connection with (a) the Participant’s or their pet’s participation in the event; and (b) any claim made against the Indemnified Persons by a third party arising out of or in connection with any of the above.
